This End User License Agreement ("Agreement") governs your use of the Ollet app and related services (the "Services"). The Services are operated by OptiML Vision Inc. ("Ollet," "we," or "us").
By continuing with a verification, you accept this Agreement. If you do not agree, stop the verification and ask the requesting organization for another way to proceed.
Using Ollet
An organization, such as your employer or a service where you hold an account, may ask you to confirm your identity through Ollet.
During setup, the app reads and verifies a supported identity credential. Verified identity data is stored on your device, protected by the storage and security features of its operating system. During subsequent verifications, Ollet compares a live capture of your face with the credential's portrait and produces a cryptographic proof of the result.
The verification process uses device attestation and cryptographic validation to assess the app's response. Identity documents and biometric comparisons are processed locally. The requesting service receives the verification outcome and the identity attributes you approve sharing. The Privacy Policy explains how information is processed and handled.
Completing a verification does not create an Ollet account or enroll you in an Ollet identity database. Ollet does not maintain centralized identity records for individuals or operate a central identity provider. Identity data retained during setup stays on your device.
License to Use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Ollet on a device you own or control, for the purpose of completing verifications requested of you.
You do not acquire ownership of the app. All rights not expressly granted under this Agreement are reserved.
Your Responsibilities
When using Ollet, you agree to:
- Present only your own identity credential during setup, and not knowingly present a credential that is altered, expired, or invalid.
- Refrain from defeating, disabling, or degrading liveness detection, device attestation, or other anti-spoofing checks.
- Refrain from reverse engineering, decompiling, disassembling, or attempting to derive the app's source code, except where this restriction is unenforceable under applicable law.
- Refrain from verifying an identity on behalf of another person or helping someone else do so.
Presenting another person's credential, or a forged or altered credential, may be a criminal offense.
Your Choice and the Organization's Decision
You may decline a verification. The requesting organization is responsible for offering an alternative. Ollet cannot provide that alternative and is not a party to your relationship with the organization.
The organization decides how to use a verification outcome, including whether to grant or deny access. Ollet does not make that decision and does not control how the organization uses information it receives.
We are not responsible for the organization's decisions, including denial of access, or for losses resulting from a verification that fails or is completed by someone other than you.
Device Requirements and Availability
The Services require a supported device with the capabilities needed to read a credential, capture a live image, and provide secure hardware attestation. We do not warrant that any particular device, operating system version, or credential type is or will remain supported.
Verification also depends on systems outside our control, including operating systems, attestation services, and certificates published by credential issuers. We are not responsible for the availability or behavior of those systems. A verification may fail for reasons outside our control.
Eligibility
Ollet is not intended for anyone under the age of 13, or the minimum age required in their jurisdiction, whichever is higher.
Apple App Store
If you obtained Ollet from the Apple App Store, this Agreement is between you and Ollet, not Apple. Ollet is solely responsible for the app and its content. Apple has no obligation to provide maintenance or support.
If the app fails to conform to an applicable warranty, you may notify Apple. Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
Ollet is responsible for addressing claims relating to the app, including product liability, failure to meet legal or regulatory requirements, and claims under consumer protection or similar legislation. Ollet is also responsible for investigating, defending, settling, and discharging third-party claims that the app infringes intellectual property rights.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on a U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance, they have the right to enforce it against you.
No Warranty
The Services are provided "as is" and "as available." To the maximum extent permitted by law, Ollet and its licensors and suppliers disclaim all express, implied, and statutory warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that a verification will succeed, that every genuine credential can be read successfully, that the Services will be uninterrupted or error-free, or that every attempt at impersonation will be detected.
Some jurisdictions do not allow the exclusion of implied warranties. Some of these exclusions may therefore not apply to you.
Limitation of Liability
To the maximum extent permitted by law, Ollet will not be liable under any legal theory, including contract, tort, strict liability, or otherwise, for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunity arising from or relating to your use of the Services, even if advised that such damages are possible.
Ollet's total liability to you arising from or relating to this Agreement will not exceed one hundred U.S. dollars ($100).
Nothing in this Agreement limits liability that cannot be limited under applicable law.
Changes to This Agreement
We may update this Agreement by posting a new version at this address with a revised effective date. Continuing to use the app after that date means you accept the updated Agreement.
Governing Law
This Agreement is governed by the laws of the State of California, without regard to its conflict of laws rules.
